CITY OF NEW YORK SUPREME COURT, KINGS COUNTY $7.8M Verdict for lost wages, medical expenses, pain and suffering for 35 year-old Brooklyn woman who was a passenger in a car that was struck in the rear by a van owned by the City of New York. The woman suffered the loss of her spleen, severe abdominal scarring and serious injuries to her neck and back which prevented her from working in her career as a nurse's aide. TRIAL VERDICT: $5,500,000 POLICE MISCONDUCT ROSARIO v. UNION CITY POLICE DEPARTMENT US DISTRICT COURT, NEW JERSEY $5.5M Verdict for false arrest, conscious pain and suffering and wrongful death for the family of a 63 year-old Union City, New Jersey man who died in police custody. The jury found that the police officers had no probable cause to arrest the man in his own home, and that the police officers were negligent in failing to provide adequate medical attention when he suffered a severe asthma attack while in police custody. Sadly, the man died in the street outside his home. STRUCTURED SETTLEMENT: $8,600,000 PRODUCTS LIABILITY Structured settlement paying out over $8.6M to family of a utility worker who was died from severe burns suffered during an electrical explosion at a worksite. We were able to obtain the settlement for the man's widow and young children after showing that the explosion resulted from a defective switch at the worksite. STRUCTURED SETTLEMENT: $2,900,000 AUTOMOBILE ACCIDENT Structured settlement with total payments of $2.9M for a Brooklyn woman whose car was struck by another motorist who disregarded a traffic signal. Although she did not initially report to the hospital, she soon developed severe back pain. An MRI revealed herniated disks in her back which required surgery. She was unable to continue her career as a special education teacher. We won summary judgement on liability by making a motion to the Court and were able to obtain a strong settlement by being fully prepared to go to trial on the issue of damages. SETTLEMENT: $2,500,000 CONSTRUCTION ACCIDENT Lump sum award of $2.5M for an employee working on the construction site of the Time Warner Center at Columbus Circle in Manhattan. Our client, a 43 year-old Brooklyn resident, fell 15 feet through an unsecured plywood floor and sustained fractured vertebrae in his back which required remedial surgery. The case was settled after we obtained summary judgement in his favor pursuant to the New York State Labor Law Section 240 which protects workers from height-related risks at construction sites. |
